David Gould Wins A Motor Vehicle Accident Case On Liability in Supreme Court Suffolk County - Jury Renders Their Verdict In 33 Minutes
On October 24, 2022, David Gould appeared for a summary jury trial in the Supreme Court Suffolk County in the Diane Pauciullo v. Dimitrios Boboris case, Index Number 612421/2019 before Judge Robert F. Quinlan. The plaintiff testified that as she was slowing down in traffic on Horseblock Road near Route 112 in Medford the defendant t-boned her vehicle as he was about to enter a parking lot. She was talking on her Bluetooth device and it was argued by the defense that she was distracted such that she did not observe the defendant’s car before the collision. The plaintiff’s airbags went off and she received a combined total of 29 trigger point and facet block injections to her back and neck to relieve her pain. After 33 minutes of deliberations the jury found that defendant was not the proximate cause of the accident and therefore did not answer any questions regarding whether she sustained a “Serious Injury” under Insurance Law 5102(d).
