David Gould with the Assistance of Joseph Fegan Score a Unanimous Defense Verdict in Supreme Court Suffolk County in 86 Minutes on a Traumatic Brain Injury Case
David Gould, with the assistance of his mentor Joseph Fegan, successfully defended a damages-only traumatic brain injury (TBI) case in the Supreme Court Suffolk County before Judge George Nolan. Christine Cirola v. Karen Johnson, Index No.: 617768-21. A total of 11 witnesses were called over a span of two weeks. The plaintiff’s attorney argued that his client sustained “a mild TBI” as a result of the accident and he requested that the jury award his client $1,010,300.00 in compensation. The defense argued that the plaintiff did not sustain a TBI as she was conscious at the scene of the accident, was not bleeding from any parts of her body, was verbal and received a perfect score on the Glascow Coma Score test. After 86 minutes, the jury rendered a unanimous defense verdict, that the plaintiff did not sustain a “serious injury”.
