Russo & Gould Secures Voluntary Stipulation of Discontinuance for Third-Party Defendants
On February 26, 2026, Russo & Gould Partner Marie Castronuovo successfully representedg third-party defendants Wallack Management, 52 East End Condominium and Board of Managers of 52 East End Condominium, securing a voluntary Stipulation of Discontinuance from the third-party plaintiff, plaintiff and all defendants and third-party defendants. The case involved a July 6, 2021, accident in which a piece of plywood fell from a building and struck both plaintiffs on the sidewalk abutting 60 East End Avenue in New York City. Plaintiff argued that the plywood came from 60 East End Avenue.
In Sandra Knowles and Umberto Talamini v Traditional Waterproofing and Restoration et al v 52-54 East End Associates et al., S/NY Index 155518/2022, Castronuovo represented the owner and management company of the neighboring building where façade restoration work was ongoing at the time of the accident. After taking testimony of all the parties, it was clear that although our client had plywood on their roof on the day of the incident, that plywood was secured by heavy weight and was not the type of plywood found on the sidewalk in the area where the plaintiffs were struck. All parties signed a Stipulation of Discontinuance for our client.
